Hello, my name is Joel Labava and I'm the franchise king. Do you really need a franchise lawyer? Do you need a franchise attorney? You know, when I first got in franchising the first few years, uh I remember more on more than one occasion, uh people that were uh working with me looking to buy a franchise uh asked me if they really need to spend the money on a franchise attorney. Um, uh, my dad taught me the answer was always yes. And, uh, I agree with them. Um, you always need to have a franchise attorney by your side. Whether you're looking at a franchise, thinking about buying one, or you have a wonderful concept that you've already duplicated once or twice, and you want to franchise your business, you need to have an experienced franchise attorney that will look out for your best interest. Now, for people looking to buy a franchise, once in a while, probably not as much nowadays, but once in a while, u you'll hear a uh a franchise salesperson, no matter what part of the franchise sales process they're in, tell you that, you know, before you hire a franchise attorney, as I know you were talking about it, uh you need to know that we are not changing anything in our franchise contract, in our franchise agreement. So, you can try and if you really want to waste a couple thousand dollars or more on a franchise attorney, go right ahead. But we're not changing anything. You know what? I don't care if a someone from uh the franchise development team tells you that. It doesn't matter. It's not their money they're about to invest. You're about to invest your money and you need protection. So, even though a franchise attorney may not be able to negotiate something for you, but you never know, uh, you still need to make sure that you completely understand the FTD and the franchise contract. So, whenever you hear someone say you don't need a franchise attorney because we're not changing anything, hire a franchise attorney. Even more so at that point. Now, if you're thinking of expanding your independent business and converting it into a franchise business, you also need a franchise attorney. Now, remember, there are 50 states in the United States. Each state has a unique set of franchise laws. And if you want to be able to sell franchises in every state, you should want to do that. You need an you need to hire an experienced franchise attorney that can help you navigate each state's laws and rules. Also, a franchise attorney can help you write your franchise operations manual and have someone by his or her side doing it with you. Uh, a franchise attorney can also help you come up with maybe some of the percentages, the royalty percentages that you want to charge or you're thinking of charging because an experienced franchise attorney knows what the ongoing royalty fees are as they know what the franchise fees are and about what you should charge. But most important, they will set you up to legally sell a franchise in the United States. It is so important to hire a franchise attorney. In both cases, whether you're looking to buy a franchise or you're looking to sell franchises eventually as a franchiseor, you must hire a franchise attorney that is experienced and that you feel you can trust because you need to protect your interests.
