there must be like 10 different class action lawsuits against artificial intelligence art companies now what the lawsuits allege I predict is going to end AI art generators as we know them let me show you how this is going to happen but first let me just say I'm Ian Corzine a former Federal prosecutor and civil lawyer I advise people on the rules of the new internet okay now let me break down the problem for you AI art generators scrape the internet to learn how to do graphic art now how do they learn basically they analyze the real human artists images that are on the internet so let's take the story of Amy stellatia she's a comic artist and last year some of her art friends said hey we think some of our images are being stolen by AI they told her about this website called have I been trained. com where she could go upload an image and see if her art had been stolen by AI so she went to this website and she was blown away by what she saw as a side note I want to be real clear about the terms I'm using in this video now Amy's friends said that the AI had stolen their art I have to say from the research that I've done AI doesn't actually steal a human artist's images no when AI is trained it familiarized itself with the way shapes normally appear in real human art and then it creates its own art from those estimates AI Arc generators are trained by adding noise to an image and then taking away that noise there's really not a good analogy to choose process in the human world but the best analogy I got ironically from chat GTP was for you to imagine a pond you look at your reflection in the pond you deposit a pebble in the pond and you see these ripples well AI art generators have the ability to d-ripple that pond and then show you your image clear like you originally saw regardless of the analogy it's clear that AI art generators do not store the images of real human artists they actually create their own art okay back to Amy's story she uploaded one of our most popular images to have I've been trained. com and the results were that most of her comic art had been used to train AI needless to say she was taken aback you know Amy believed that the AI art generator should have gotten her permission before they used her art this principle is consistent with copyright law which says that an original creator of art can protect that art and people can't take it without that person's permission this principle is also consistent with those class action lawsuits I talked about at the beginning of the video which have been filed in recent months in record numbers in U. S federal courts and as I said before I think these lawsuits are going to take away our ability to use these AI art generators as we have up until now let me break down the allegations of these class action lawsuits in Anderson versus stability AI three graphic artists have sued mid-journey deviantART stable diffusion and they're alleging that these AI art generation companies have taken their art without their permission and they deserve to be paid for that now the key question in this lawsuit and many others like it is whether or not these AI art generators actually took the artist's art so I researched this on the internet and I found that AI art generators don't actually take and store the digital files of human artists to train themselves actually they just analyze these images they look at these images now the key question for this court in Anderson and other cases is whether or not this look this analysis of human artist images is enough to allow them to allege copyright infringement and go to the jury now my prediction on this case and how it will be decided is that I believe that probably the AI art generation companies will settle before it even gets to this summary judgment type question second even if it does go to summer judgment I think the artists are actually going to lose on the copyright infringement claim there just isn't enough evidence that the AI art generators when they're training actually take the images of the human artists however either way I think this case is going to be settled before it goes to a jury and that spells bad news for you and I why because right now you and I can go to Discord and go to the mid-journey server and get as many images AI images as we want and then put them on t-shirts this isn't a t-shirt but mouse pads or anything and sell them commercial really we can do that because basically there's not many restrictions on how we use AI art and it's free but I think that these companies who are being sued right now don't want to get sued over and over again so my projection is that cases like these will be settled and then the AI art generation companies are going to put a paywall between you and them you're gonna have to pay money and even then sign a long big bad license agreement which requires you to indemnify them for any lawsuits that are after you use an image and also forbid you from using any of the AI images the way you want as the judge I used to work for always said lawyers always everything up all right that's all I got for today for more videos on the rules of the new internet subscribe and join my email list at the link below also for my free online course on the metaverse there's a link
