People are now making a new type of Will - it is called a Living Will, and it can save you from going bankrupt in case God forbid any family member is hospitalised because of a severe illness... The concept of a Living Will is relatively new to India... and the awareness is low at the moment, but Courts want people to be educated on the concept. A Living Will is different from a regular Will that you use to pass on assets to your family members... It is a document in which you state that in case you go through a medical situation, where you are unable to take a decision for yourself or speak for yourself, what procedures should medical professionals be allowed to carry out on you or not... A lot of people have seen loved ones on ventilators for months, and being kept alive through feeding tubes knowing that the chance of recovery is almost negligible or next to nothing, but such long hospitalisation on ventilators keeps draining the family’s resources... Nor does it give any true life to the patient... So the Supreme Court through its rulings in 2018, and then subsequently in 2023, made the process of making a Living Will easier... With support from two witnesses, and a medical practitioner, you mention in writing that if you are in a medical situation of a coma or a vegetative state for a few days, where should you be taken care of - should it be at home, or at the hospital... What processes, ventilators, tubes, CPRs, what kind of pain killer medications, dialysis, should be permitted to be used on you... And who will be the person to liaison with the doctors, and in which state should you be allowed to leave. If you don't want your family to go bankrupt, you can't miss this. The Supreme Court now wants people to make a new kind of document which could save your family's finances. Now, I'll explain the background. You know, the biggest problem with going to hospitals today is a lot of times a family member of yours, you know, it could be a senior citizen or someone who's battling a disease. When they get unconscious for a few days or imagine they get into a vegetative state, the hospital and the doctors will decide to put them on a ventilator and feed them through feeding tubes. After a few days, the entire family will realize that now this person is not coming back. However, medical procedures will keep that person alive for weeks and thus draining lacks in money and resources every single day and then the family feels guilty because no one wants to take the decision of putting that person off of the ventilator even though everyone knows that they're not coming back and you can't voice it. Which is why the Supreme Court in 2018 came up with a concept which they simplified in 2023. This concept is called a living will. And no, it does not mean that you give away your assets while you're still alive. It essentially means that if you ever find yourself in a situation where you're unconscious or you're unable to take a decision for yourself at that time, what kind of medical procedures, what kind of medicines should doctors and hospitals be not allowed to put you through? Now imagine if you are unconscious or vegetative, you don't want them to put you on a ventilator and feeding tubes for weeks. It will drain your family's finances. Plus, you know, you want to live and die with dignity. And the Supreme Court appreciates it, but they realize that not enough people are aware about it. Which is why if you have senior citizens in your family, it is really important that you look up the concept of a living will. Share it with them.
